William E. Penley, of Scarborough, was hunting turkeys with his grandson at the residence of a family member on the Richmond Mills Road in Wayne Oct. 8, according to news release from the Maine Dept. of Inland Fisheries and Wildlife.

Penley was sitting in an outcropping of trees near the wood line watching a flock of wild turkeys in the yard. Penley shot his 12-gauge shotgun at a single wild turkey in the direction of the Richmond Mills Road, according to the release.

“Unknowingly to Penley, a couple were walking their dogs and watching the same flock of wild turkeys from the Richmond Mills Road,” the release said. “When Penley shot, a single pellet from the round struck Richard Hannibal, of Fayette, in the chest as he stood on the roadway. Medical personnel arrived but Hannibal refused treatment.”

This incident is still being investigated by Maine Game Wardens, the release said.
