Philip Telinda, 79, was arrested and faces a charge of taking possession of an alligator without a license and resisting arrest.
Telinda trapped a three-foot gator, placed it in his van and drove away.
The gator had its snout taped shut and was in the back of the van. Telinda, who has a Florida concealed weapons permit, had a small gun on him when his van was pulled over. When deputies told him not to retrieve his weapon he did not listen.
Florida Fish and Wildlife relocated the gator.
