Scott R. Brooks, 27, shot his brother in a hunting accident in the town of Dix early in the morning on Nov. 19.
Brooks discharged one round from his rifle nearly two hours before legal hunting time, striking his 24-year-old stepbrother. Brooks told police he mistook the man for a deer.
The stepbrother survived, but required surgery that day, the DEC said.
