William Pugh Jr., 50, was hunting in Jefferson Township Oct. 1. He was sitting in a tree stand with a crossbow. There was a pile of apples in the woods near the tree stand, according to court documents.
During the investigation, wildlife conservation officers saw that Pugh had an open beer in the left front pocket of his hunting jacket. An empty beer can was found at the base of the tree stand.
Officers gave Pugh a breath test, but Pugh refused to submit to blood alcohol testing.
Pugh was charged with hunting or fur taking while under the influence of alcohol and unlawful devices and methods.
