Dennis Ubert, 56, was struck just below the jaw by a lone pellet when hunter Adam George, 34, fired a shotgun at a flushed quail in Brecknock Township on Feb. 20..

The pellet missed the victim’s carotid artery in his neck by a fraction of an inch and lodged in the saliva gland.

George said the lone pellet that struck his hunting companion had ricocheted into him. But Graham said his investigation showed the victim was in the direct line of fire, about 32 yards away.

George was issued a citation for a summary offense of shooting at or causing injury to a human being. The violation of Pennsylvania game laws carries a fine of $1,000 to $1,500 and jail time of up to 90 days.
